Everything was settled except the areas to be exchanged, for which surveys had to be made by me, there being no proper surveys in the possession of the Colonial Government. I was therefore rather surprised that the Colonial Government withdrew from this arrangement without assigning any reason whatever.

Regarding paragraph 5 of His Excellency's Despatch, the phrase "Military Reserve Lands" has never been accurately defined, but whatever the definition may be, the Military Reserve at Kowloon would require a special definition, as it was acquired under special circumstances.

The Kowloon Reserve was occupied by the British Troops before the treaty of Pekin, at the time when our arms had suffered a reverse at the Taku Forts and European prisoners were being tortured at Pekin.

By article VI of the Treaty of Pekin in October, 1860, it was handed over to Her Majesty with a view to the Maintenance of law and order in the Harbour of Hong Kong, and
